Terms of Service
These terms are an agreement between you and Damian Diaz ("we", "us") for your use of the Open Galaxies War app and its online services (the "Game"). By installing or playing the Game you accept them. If you don't accept them, don't use the Game. Our Privacy Policy and Community Standards are part of these terms.
1. Who can play
You must be at least 13 years old. If you are under the age of majority where you live, you need a parent's or guardian's permission to sign in and to make purchases. The parent or guardian accepts these terms on your behalf and is responsible for your purchases.
2. Your account
- You can play as a guest, with progress saved only on your device. Signing in with Google or Apple keeps your progress on our servers. If you lose a guest device or clear the app's data, the guest progress cannot be recovered.
- One commander per Google or Apple account. Keep that account secure. You are responsible for what happens under it.
- Callsigns must follow the Community Standards. We may reset a callsign that breaks them.
- You can delete your account at any time (see Delete your account). Deletion is permanent.
3. Virtual items and currency
- The Game includes virtual items: Data Cores (premium currency), resources, crates, the premium battle pass, offers and Commander VIP. We grant you a limited, personal, non-transferable, revocable licence to use them in the Game. You don't own them, and they have no cash value. They can't be exchanged for real money, goods or services, or transferred or sold to anyone.
- Selling, buying or trading accounts or virtual items outside the Game is not allowed.
- We may change, rebalance or discontinue virtual items, prices and rewards, and change the rules for earning and using them. If we shut down the Game, we will give at least 30 days' notice in the Game. Unused virtual items then end without refund, except where the law requires otherwise.
4. Purchases
- Purchases are made through the store you installed the Game from, Google Play or Apple's App Store (the "store"), and are subject to that store's terms and payment policies. The price shown in the Game comes from the store, in your currency, including any taxes it collects.
- Our servers credit each purchase to your account once Google confirms it. If a purchase doesn't arrive, reopen the Game while online. If it still doesn't arrive, contact support.
- Refunds. All purchases are final once the item has been delivered, except where the law requires otherwise. The store handles refund requests and may refund you under its policies. When a purchase is refunded or charged back, we remove what it granted, even if your Data Core balance goes below zero. Accounts with repeated refunds or chargebacks may be suspended.
- Commander VIP is a monthly subscription that renews automatically at the price shown until you cancel. Cancel any time in Google Play → Payments & subscriptions → Subscriptions, or on iPhone in Settings → [your name] → Subscriptions. It stays active until the end of the paid period. Benefits: 10 Data Cores a day when you open the Game, a free crate every 2 hours instead of 4, a second free spin a day, and a VIP badge.
- The premium battle pass applies to the current season only.
- If you live in the EU or UK: by buying digital content you ask for it to be delivered immediately, and you acknowledge that you then lose your 14-day right of withdrawal.
5. Random rewards
Supply crates and the lucky spin give random rewards. They are earned by playing and can't be bought. Their odds are shown in the Game (tap View drop rates or View odds) and on our drop rates page. Every crate always pays out. The server decides every roll.
6. Fair play
You agree not to:
- use cheats, bots, modified clients, emulators to automate play, or exploits;
- tamper with the Game, its servers or other players' data, or reverse engineer the Game except as the law allows;
- use more than one account to gain an advantage, or to push another player's rankings;
- harass or threaten other players, or post content that breaks the Community Standards;
- use the Game for anything illegal.
Our servers verify raids and actions. If we find abuse, we may remove gains obtained unfairly, reset rankings, hide content, or suspend or close accounts. Where appropriate, we will tell you why and how to contact us.
7. Content you create
Callsigns, alliance names and chat messages remain yours. You give us a worldwide, royalty-free licence to host, display and distribute them in the Game, as needed to operate it. You are responsible for what you post. We may filter, hide or remove content that breaks these terms.
There is no tolerance for objectionable content or abusive players. Before your first alliance chat message, the Game asks you to accept these terms and the Community Standards. You can block a player, which hides their chat messages from you, and report players, callsigns, alliance names and messages from the player's profile or the chat. We review reports, aiming to act within 24 hours, and may remove content and mute, suspend or close the accounts responsible.
8. The service
The Game is provided "as is" and "as available". Online features need an internet connection and may be interrupted for maintenance, updates or outages. We may update the Game, and some features may need the latest version. We don't guarantee that the Game will be free of errors or that it will always be available.
9. Liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or virtual items. Our total liability for any claim is limited to the amount you paid us in the 6 months before the claim, or US$50 if you paid nothing. Nothing in these terms limits liability that cannot be limited by law, or your statutory rights as a consumer.
10. Ending these terms
You can stop playing and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these terms. Sections 3, 4 (refunds), 7, 9 and 11 survive termination.
11. Law and disputes
These terms are governed by the laws of Spain, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in your local courts. Please contact us first. Most problems are solved quickly by email.
12. Changes
We may update these terms. We will change the date above, and tell you in the Game before significant changes apply. Continuing to play after they apply means you accept them.
13. If you got the Game from Apple's App Store
Apple requires these terms to include the following:
- These terms are between you and us, not Apple. We, not Apple, are solely responsible for the Game and its content.
- Your licence is limited to using the Game on Apple-branded products you own or control, as the App Store's Usage Rules allow (including through Family Sharing).
- Apple has no obligation to provide any maintenance or support for the Game.
- If the Game fails to meet any warranty that applies, you may notify Apple, and Apple will refund the price you paid for the Game, if any. To the extent the law allows, Apple has no other warranty obligation for the Game. Any other claims, losses or costs from a failure to meet a warranty are our responsibility, as far as these terms don't exclude them.
- We, not Apple, are responsible for any claims about the Game or your use of it, including product liability claims, claims that the Game fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If anyone claims that the Game, or your use of it, infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not in a country subject to a U.S. Government embargo, or designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must follow any third-party terms that apply when you use the Game, such as your wireless data service agreement.
- Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.
